  • H1B before completion of masters

    I am currently a masters student here in the US..i have one more semester(spring 2015), 6 credits(2 courses) to graduate and i will be done in may 2015.. i have recently found a job in an organization which is exempted from h1b quota..they want me to start from first week of january 2015 and are ready to file my h1b under my bachelors from india..
    My questions are :
    1) under h1b can i still study and finish my masters(6 credits) in spring 2015 semester..
    2) since it is 6 credits isn't that counted as part time ?
    3) am i violating my f1 visa in anyways?
    4) say i get my h1b in jan 2015..how early can i file for my GC?
    5) can i file GC under EB-2 category once i am done with my masters in may 2015.? or do i have to file under EB-3 since my h1b is on my bachelors degree..

        3) no
        4)depends on the employer of urs
        5) i am guessing it ll be EB3 Initially n later upon recieving of ur masters degree, you can get it changed to EB2 with the degree certificate.

          1) yes, 2) yes, 3) No, 4) As soon as your employer starts GC processing, 5) since your job is based on bachelors degree it will be EB3, and then you have to amend that to become eb2 with masters degree and enough years experience, your employer can help you on this.

              It means when you work for a non-profit organization like universities or hospitals etc, ur H1 comes under cap exemption n it can be filed at anytime of the year without a lottery. You dont have to wait till april of each year.
              However as chandu mentioned, if ur non profit job contract gets done n u want to shift to a regular IT job, u ll have to get ur H1 filed again thru the lottery system.

                2 dont worry f1 rules does not apply if u have h1 u will be treated like citizen

                5 gc is based on job requirements
                If job requires a masters or bs + 5 yrs exp then u can qualify for eb2/

                  And remember if u want to convert to a cap subjected job u have to apply new cap subjected h1 ( means job transfer is not easy )
