    Hello Everyone,

    I have completed my Masters in USA. Worked there till my OPT Extension (Expiry June 2015). Due to some Family problems I had to leave USA and come to India. Its been 6+ months now. I want to come back to USA and resume my career. My employer is willing to sponsor me H1. So, can you please help me? I want to know how to apply for H1 from India? what documents I need to provide. Has any one seen this kind of Situation? please reply me. Thanks in advance

      Many people apply for H-1B from outside the U.S. It’s the same exact process as if you were in the U.S.; the only difference is that you cannot come to the U.S. until October of next year. There is a yearly cap for H-1B so your employer must apply by April 1 so you can begin working on October 1st. You will also need to get visa stamping done before you come.           1) The same process as for everyone. Your company can get your LCA certification and file H1 for you in April 2015 under Masters Cap.
          2) Your company attorney should be able to send you out the checklist of documents required. Find the link below:

                  Of course your employer can apply for your H1B when you're in India provided you give them all the necessary documents. But, before that, if you don't want to waste time, you can come back to USA on your OPT or OPT extension card and you should be good to enter USA and resume your work. Hope this helps! Good Luck!
