I am currently on H1B which is valid until Sept 2015. I got laid-off and my last day with the current employer is Nov 24th 2014.
Not having found a job related to my experience/field, I plan to buy some more time by going to F1 visa. (This is by enrolling for 12 units in a certificate program at UCSC - extension.) The Winter semester starts on January 3rd 2015 and my courses in the following weeks.
My question is :
1. Once I have my I-20 from the school (I expect to have the I -20 before Nov 24th 2014), Can I file for a change of status from H1 to F1 and stay legally in the US?
2. How much time do I have after Nov 24th 2014 file a change of status. In other words, how many days am I allowed to stay legally after the 24th?
2. Since I already have H1B which is good until 2015 - After moving to F1, If I find a job ( say in Feb 2015), can the employer file change of VISA F1 to H1B and hire me? OR I need to go through the H1B CAP ?
