H1B to F1 and back to H1B

Hi all,

I am currently on H1B which is valid until Sept 2015. I got laid-off and my last day with the current employer is Nov 24th 2014.

Not having found a job related to my experience/field, I plan to buy some more time by going to F1 visa. (This is by enrolling for 12 units in a certificate program at UCSC - extension.) The Winter semester starts on January 3rd 2015 and my courses in the following weeks.

My question is :

1. Once I have my I-20 from the school (I expect to have the I -20 before Nov 24th 2014), Can I file for a change of status from H1 to F1 and stay legally in the US?

2. How much time do I have after Nov 24th 2014 file a change of status. In other words, how many days am I allowed to stay legally after the 24th?

2. Since I already have H1B which is good until 2015 - After moving to F1, If I find a job ( say in Feb 2015), can the employer file change of VISA F1 to H1B and hire me? OR I need to go through the H1B CAP ?

Appreciate any help/inputs/advises.

2 u can not stay after they with draw u r h1 .. If they with draw ur status then u can not file cos ..
3 nope u dont need to go for cap again if u r previous h1 was cap subjected h1

you have 60 days to change status to F1 or to find another employer

There is no grace period for h1 ..
U will have no status after termination of h1 status ..

After h1 revoke we still have 60 days to leave the country ! I checked with attorney last month !

Hi guys one question.....is it necessary to apply Change of status when the person h1 ends in 2015 and he/she still have valid F1 visa till 2016 or else simply one can get I 20 and continue education after his/her h1 expiration in 2015
