  • H1B transfer

    I was on H1B and was fired due to funding issues by A. I have found a job with B and it has been 5 days since the last day of employment with A. B wants to know if there is any way for me to start working without going back to my home country. Please help on this regard. Its very urgent. Any response would be highly appreciated.

        Don’t you have an attorney? IF B doesn’t have an attorney, then you need to get one. Don’t let the company do the H-1B by themselves, especially in this type of situation.
        Generally, a few days gap is overlooked by immigration, but the company should not file this on their own.

                You have 60 days to transfer your H1B , initiate transfer your H1B to B company and once you get your receipt number for H1B transfer , you can start working with B company ! If your H1B get approved with I-797A you don't need to go to home country !
