  • Can I come back to the US on F2 status ?

    Hi folks, Thanks for helping out with various forums for students like me. I have a question to the readers. I got my H1B approved for next 3 years starting October 2014. I plan to go for H1B stamping soon by start of next year. My question here is, if god forbid something crazy happens in the Visa interview and I am somehow not able to come back into the US. Can my wife who is a F1 student get me back here on F2 status after filing for F2 visa?

      You have not provided enough information like: was the H-1B filed as a change of status? If so, you are in H-1B status right now so why are you going for stamping? If the H-1B was a Change of status, you don’t NEED to do stamping. You just need to get the stamping done if you plan to travel. Or was the H-1B filed as a consular processing application and you need to go for stamping to activate the H-1B? If that is case, have you considered Canada? If you got a US degree and need to get the H-1B stamped, you can get your H-1B stamp at a US Consulate in Canada so you don’t have to return all the way to India or your home country.
      Regardless, if your H-1B interview doesn’t go well, yes, you can try to apply for an F-2 visa to return to join your wife.

              Generally yes .. But it depends on u r rejection reason ( criminal history or status violations may effect u r f2 also)
