    Hi,

    Can you tell me for each stage how much does the employer spends.
    And which stage can I change from employer A to employer B to be on safer side.
    And when I switch to employer B again should the employer B need to spend money again.


    Stage 1 : PERM/Labor Certification Stage
    Stage 2: I-140 Immigrant Petition Stage
    State 3: I-485 Adjustment of Status Stage

      The cost depends on what the lawyer charges. There are no “filing” fees for the Stage 1, but there are legal fees and advertising costs. Both must be borne by the employer. For Stage 2 and 3, there is no requirement that the employer pay for the legal fees or the filing fees.
      If you want to avoid starting from scratch or having employer B have to spend additional funds, then you need to wait until you have filed Stage 3 AND the AOS application has been pending for at least 180 days. At any stage before that, Employer B will have to begin again from Stage 1.

            Stage1:Initial Conversation for Job Description : 1 to 2 Months
            Prevailing Wage Determination : About 2 months
            Recruitment and Filing : 3 to 6 months
            PERM Labor Approval : 2 to 8 months. ( as of August 2014, PERM approval time is 6 months)
            Stage 2:After I-140 is approved, H-1B employee will be able to extend the H1B for 3 years period beyond initial 6 years.
            Stage3:Priority date is the date that the PERM/Labor Certification Application was filed with the DOL.

            Long wait times are due to unavailability of Green Card Visa numbers.

            There is certain number of Green card applications are made available per year per category per country.

            Every month Department of State publishes the Visa Bulletin, with available visa numbers based on priority dates.

            While filing I-485 application, you could file for EAD and Travel Permit (Advanced Parole).
