  • Payroll inconsistency during OPT - Chances of RFE while applying for H1B

    Hi DesiOPT

    Please help me with the following situation:

    My OPT start date was May 2013 and worked for a employer from June 2013 to May 2014. However, the employer started my payroll from September 2013.

    I had health issues so I resigned from my ex-employer once my STEM OPT got approved and joined a consultancy, to avoid unemployment days during STEM OPT period. The consultancy gave me an offer letter mentioning my designation and salary. I updated my university with the details of the new employer. I am hoping to get back to work from February 2015 but the consultancy is not running my pay roll all these days.

    So now that I did not have any pay during May 2013- Aug 2013 and during June 2014- Feb 2015, my questions are:

    1) Although, I maintained my status by being employed all through my OPT and STEM OPT period, will it be a problem when I apply for H1b in April 2015 with such inconsistencies in my payroll.

    2) Will this cause any RFE when I apply for H1b?

    3) What can I do to avoid any sort of discrepancies in my file? Can the consultancy be able to run my payroll from June 2014 or what possible explanation can I give for not being consistent in my pay roll.

    4) How may months pay stubs are needed for filing H1b?

    Please help me.

            If uscis asks more details about Inconsistency in pay payroll .it can be addressed properly by showing good documentation about u r unpaid sick leave but it needs support from u r employer ..
            2 generally no ( as long as u dont make any confusion in u r h1 application)
            4 generally last 3 months ..
