H1B Stamping in Jamaica

    His F1 valid until 2015 so from Oct 1st he will be on H1B status. If he move out from country and can come to united states using F1 visa valid till 2015 with new I20, so thats called change of status at the port entry and he will be on F1 status with new sevis no and can enter with valid F1 visa, so there is no end of visa. Remember status and visa both are different.....H1b visa and h1b status....with status you can stay in USA but if you want to travel and enter usa, you need visa....I20 is same treated like I797 for H1B. You can travel with your old valid H1b visa with different I797 too, thats law....same applies to F1 valid visa and new I20 with different sevis.....

    He cannot because the I20 calls out the COS and the F1 will end on September 30th completing his SEVIS.

    In case if you think what happens when your H1b denied..there's no need to worry you can come to united states with valid F1 visa and I20..though you went outside country for H1b stamping..and start H1b status from oct1..no problem..only at the time of entry to USA they ask you visa..so you need to provide F1 n I20..you are good to go..but one thing is you will after that no longer on H1b status..so again you need to apply for new H1b as cos(change of status) is applied in you h1b to F1..so no issues until you have valid f1 n i20

    I think he can be back if he gets a new I20 from a different school, Worst case scenarios all stuck in Jamaica and No way out then keep paper work ready for a different school or same school for different course and reentry will not be an issue... Goo for it....

    Just have all ur docs ready n handy. Good luck.. But if you dont get the stamping, i dont think u can be back on F1 cos your F1 would end on sept 30th.

    1) There is nothing like chances of getting visa. If u have all the required documents and job you can go for stamping. Jamaica accepts change of status stamping for F1 to H1
    2) Once you go to stamping the first thing the consular officer does is he would cancel your previous Visa. So you will no longer have an F1 visa.

    1) If you have all the paper work there are 100 % chances that you will make it, Since you visa is not expired you can always be back on F1 visa, there might be few questions related to why you are here at port of entry in Jamaica and be can just say you are there for H1b stamping and will go back. Indians dont need visa for jamaica problem would be dates. Let me know if you have any questions and type of questions that they might ask..... Good Luck... 2) You have the visa you can go back to any other country get the new i20 and come back, I dont think that you visa will be denied as I have never heard about any such scenario in Jamaica, Port of Entry in US is will also be little for you as they will not ask too many questions.... Accommodation is also very reasonable in Jamaica and another good thing is that even if you get an RFE it will be resolved quicker than in India...

    Why are you going for stamping in Jamaica? Are you going there for vacation and will attend stamping there? Have you checked with the consulate to make sure they will entertain third-country nationals? If the consulate allows TCN’s and you are eligible to get a visa there, then your chances of getting a visa there are the same as everywhere else, presumably. If your visa gets denied, it really depends on the reason for denial. They may, for example, recommend that you apply for the visa in India so it’s not truly a denial.
    You may be allowed to come back in F1 status if you get a new I-20, but it will need to be from the same school. You may want to speak with an immigration attorney before traveling. If you don’t have one, visit here to speak to one: http://consultattorney.visapro.com/
