  • Green card while on STEM OPT extension

    Hi,
Heard about the impending executive action on US immigration which might reduce the backlog of green cards . Since the probability of getting selected in H-1b lottery is always an issue, can my employer file for Green card while on STEM OPT which expires on 15th June, 2015?

Your employer may file for your green card at any time. The issue becomes travel on the F-1 once an immigrant visa is filed and questions about “intent.” You may want to speak with an immigration attorney. I have never heard of being able to file for GC without going through H1B first ( assuming you have a Bachelors or Masters)

Accepting immigrant visa while you have non-immigrant visa may be problematic
