  • H1B still processing, not applied for OPT on 60 days grace period

    Hi,
    My consultancy company applied for my H1B while i was still doing my masters (under bachelor degree quota) and it is still under processing. I am on F-1 and again filed for premium H1B last friday for quick response. I graduated in MS Computer Engg in August 2014 and on 60 day grace period.

    I have not applied for OPT ever. I was on CPT and my project just ended last friday, so did my I-20.

    I heard that I will not be able to apply for OPT if my H1B is rejected. Is it true ?

    Can I apply for OPT after H1B rejection ?

      You need to speak with your international student advisor at your university. OPT applications must be filed no earlier than 90 before the program end date and no later than 60 after the program end date, which should mean before your grace period ends. Also, depending on how much CPT you used, your OPT may be limited as well. An H-1B rejection should not affect your ability to get OPT as you are presumably still within 60 days of your program end date.

          You can apply for your OPT 90 days prior to your scheduled graduation or 60 days after your graduation. H1B rejection has nothing to do with OPT filing.

          Since you are in your grace period apply your OPT asap. All talk to your DSO regarding the same.

            1) No you can apply for OPT but if you used 1 year for CPT then there might be some problems 2) Yes apply before the grace period and you are in good shape... Good Luck

                    my strong suggestion is apply for opt as soon as possible ..
                    if u wait for h1 u may loose option to apply for opt

                        I had never seen a bachelors degree quota in H1b. First time listening. H1b has nothing to be done with OPT.
                        Goahead and apply for OPT if your CPT is less than 1 year. (Even 363 days is fine which is less than an year). If you CPT is 1 year or more, you are not eligible for OPT.
