  • Cop warning- Driver License and OPT Expired

    Hi, My opt expired on july 24 but as I had applied for h1b it automatically got renewed till sep 30 as h1b starts on oct1. My question is my drivers license also expired on july24 and I went to dl office to renew my license with h1b approved copy. They say that I cant get my license renewed until oct1. Yesterday I was pulled over by a cop and he gave me a warning for driving on expired license. I need to drive everyday to go to work. What do I do now? Please help me with suggestions. THANK YOU!

    I was in the same situation..u need go to the international office in ur school and show them ur I 797A H1 B visa approval..they will issue you a new Cap Gap I-20 saying OPT employment approved till 9/30/14..you have to take that I -20 to the DMV and they will give you a drivers license upto 30th sept..u will have to go back to the DMV on OCT 1st to get ur new license for the next 3 years..

      Hey, i have been driving my car with expired licence saying temp visitor but my actual dl doesn't really expire until next year. I was pulled once but no questions raised. Not sure if that applies to you.

        You need to carpool or use a cab service. Seems like a no brainer to me. This is not India. You just follow rules. When I graduated but my opt had not started, there was a 1.5 month period when I couldn't renew my license too. Just be aware of rules.

          In some states you can use your Indian license. Or whichever country you belong too. If you have an international permit that's even better.

            thats a sad situation. The chances are you will get pulled over again..arrange for a ride or take the bus. which state r u from?

              What Ansaar has said is the best viable option. You should have an I-20 approving your Cap-Gap prior to start of H1B from October 1st. However DMV rules differ from state to state. You can visit your DMV with I-20, if again they refuse to renew, you can ask for a secondary check from USCIS to validate your legal presence in the US. It usually takes 7 days and a letter is mailed that validates your presence. With that letter you can get your license renewed. Hope it helps.

                International permits are only applicable if your stay in the country is less than 6 months and the Visa type does not allow you to get a US license. What you are talking about is usually valid for B1/B2 visas.

                  Hi, If you have your H1 approved and you have received your paper work, that would be enough for you to renew your license. I recently got my license renewed with my H1 papers and my opt expired on 7/30.

                    I had similar situation recently and DMV denied to renew my license, but DMV have given me SAVE Verification - Request Form Division of Vehicles.
                    I submitted form through email and got the approval/acceptance letter by next day. I took this letter to DMV and got my license renewed on same day. Not every state may have this option. I had this issue 2 years ago during my Opt ext also, there DMV had opened case for me to USCIS and got its approval after a week. Try asking these 2 options.
