  • H1B Approved, Company Shut down during OPT

    My H1B was approved and starts from Oct 1st 2014. Before Oct 1st 2014 can I transfer my H1B to a new company as my current company is shutting down.
    I am currently on my CAP-GAP.
    What are the risks involved if I am transferring before Oct 1st? Are there any documents required to be collected from the current company.

        I dont think there are any , but probably the to amend you H1b it will take some time, Since you are still on F1/ OPT Extension it should have a minimal impact. Talk to your new employers lawyer before you make any decisions. If you are working for a good client then it better to be prepared with all the documentation required to amend the visa or go for a interview... Good Luck

          1) Transfer technically means application for a new H1 B with new employer. Since u r already counted in the cap count u r good to go.
          2) Get the experience letter from the current company it will be useful in the future for your green card processing I-140 stage

              Hi, talk to your immigration lawyer, the policy has changed and now you cannot transfer before October 1st. I confirmed this, since i was trying to transfer to a new employer too.

                  Excellent response, this covers the dilemna which i was told, i will explain the situation I had so that prospective candidates can take decision accordingly: if you are on STEM OPT with H1B approval with consular mode, or you have a valid OPT with H1B approval on consular mode, or your current employers withdraw your petition of H1B before new application is processed by new employer, than you can't transfer.

                    Yes first initiate your transfer and grab your experience letter since ur h1b is approved so you are good to get transferred no risk involved it is just like getting your transfer from one employer to other , simple but make it faster .

                      1 yes but do it as soon as possible if u r employer withdraws it before oct 1 u can not transfer after withdrawal ..
                      2 collect all u r 797 receipts and employment verification letters ..
