  • H1B picked in lottery and receipt received, Got to know it was picked in error

    Hi,

    I got my H1b application picked in the lottery on April 10th and received the receipt acknowledging it. I was tracking the status for a while which shows it is in Initial review. I was in assumption that it gonna take some time, but I got a call from my employer saying that he received a letter from USCIS stating that my H1B was not picked in lottery and the receipt was generated in error. It sounds weird to me. My employer says he gonna request USCIS to consider my application as it was their mistake. Anyway I have different questions in my mind;

    1. Does anybody face this situation earlier?
    2. Can USCIS do such kind of mistakes?
    3. How do I proceed in this situation?
    4. Does USCIS accepts my employer request to consider my application?

    your insight in this situation is greatly appreciated.

          I saw same kind of post in the month of may. Some one requested for similar info. It is really bad on uscis part to do such mistakes. For uscis it is just a random number but for us it is our career

            3.u can file a case (make sure with u r employer)
            4.Even they will not ans u r employer question.

                  I applied h1b this year. I also got the same letter this year. Can you update what happened to your case. Did the process your H1 ?

                        Hi, I received the same letter that says fee will be refunded and it also says it does NOT affect the processing of the case when I check the status online with the EAC number. Do you see the similar message? and have you gotten any update regarding your case?

                          Hi Guys,

                          My h1 got picked , when am trying to track my case status. Its still like a mystery, i am getting some validation errors, after looking at this post. I was shocked and worried , how usics can do like this. I got few questions, please reply....
                          1) Does ur check encashed
                          2)Did you got the receipt notice
                          3) Is there any changes happen on ur sevis -id

                            2)yes with an EAC number
                            3) Yes. Changed to active (Cap/Gap) as told by my DSO

                              Hi Ums101,

                              Thanks for the quick reply, One last question buddy. What status you can see, when you trying to track the case at uscis.gov. I can my status like this "At this time USCIS cannot provide you with information for your case. Please contact the NSCS 1 (800) 375-5283 for additional information. " , is this the same thing ur seeing ??
