  • H1B query: Maintenance of Status

    Hi friends,

    Here is my case: As I had issue with OPT STEM extension, I joined a college in october, 2013 for second masters. As it was middle of the semester, college asked me to join in the English course mentioning on my I20 that, I dont have enough english skills and later got me enrolled in Masters starting next semester (Jan 11, 2014). But, my query asks me to prove that I am legally staying on F1 visa from Jan 11th, 2014. So,my questions are:
    1) do i need to show the proof that I joined the college(in october,2013) even back than the date they mentioned on the query(Jan,2014)? If so, would it raise a new question to them that, what might be the reason I joined the English program inspite of completion of a Masters in USA?
    2) I heard that usually, for the queries on CPT, the H1 might be approved after the submission of the relevant documents, but, the Change of Status might be denied. Is it so?? If so, how many days will I be given to get the stamping done..

    Please leave your thoughts or suggestions.

        1 just from jan 2014 will be fine ..
        2 it depends .. If u dont get cos then u can go to stamping any time before opt expiry or u r f1 end date

          You can join any classes.You can go for undergrad or even lower degree , although you have masters degree. It does not matter as long you are in F1. One of my friend had to go his country for the stamping. It would be better if you prepare ahead, just in case you have to go for stamping, which is most likely. Good Luck!

            If at all I need to go for stamping (when my cos is denied), how much time will i be given? Because, I need to get prepared before sending reply, if they ask me to get stamping done immediately..
