  • H1B RFE response time - Premium Processing from Regular

    HI,
    Thank you for answering my previous questions and for others as well.
    I have applied for H1 in regular processing, it was selected. I do work for a consultancy. I did get an RFE asking for a client letter or Master Service Agreement (MSA) or Statement Of Work (SOW) between my implementing partner and end client. I was not able to get the client letter but my Manager managed to give me the MSA between his company and the end client. I did submit the complete link (MSA's) between my consultancy, the prime-vendor, implementing partner and end client along with respective pay stubs.
    Please answer my below questions.
    1. I want to change my process from regular to Premium, after getting an RFE. My employer says it is not a good idea.. Can you please suggest me on this.
    2. How long will USCIS take to respond towards my RFE and give a decision under Regular Processing.. and how long for premium processing?
    3. My OPT ends in December 1st week. When shall I start applying for Universities as a back-up.

        1. What your employer said is the right thing. If you go for premium processing, chances of getting rejection is high(Because they think you're trying make it faster as you don't have stability towards the employment as you did regular processing earlier)

        2 . USCIS usually takes 1 or 2 months after you responded to your RFE in regular processing, where as 2 weeks max for premium.

        3. There will be some universities, who offer courses starting of October I guess (not sure). You can go for the universities who start around October.

          Follow your employer better in your case stay in regular processing. USCIS generally takes 90 days time to respond to your RFE. It is still June so by most of the case your RFE decision will be back by the month of August or September 1st week from now .

            If there is no urgency.. My suggestion would be to NOT escalate to premium..
