  • RFE for H1B application - Asking for not mentioned Client letter

    Hi,

    I am currently working with one State project through Implementation partner.The contract between the State and the Implementation partner is Fixed bid project. I am a contractor to the Implementation partner.So the State is not responsible for any documentation regarding the Immigration issues.

    My employer filed LCA with the Implementation partner name as client and the location as State project location as I am working from that location.

    now In RFE USCIS requested to submit the client letter from State and PO between the Implementation partner.But the Implementation partner is now willing to provide the PO between State and it's own as I am a contractor to them. State is not willing to provide the Client letter as I am not directly working with State. I don't even have a State email address also. I have only implementation email address, ID, Timesheets , all are with the name as Implementation partner.

    Could you please help me in how USCIS found that I am working with State even I didn't provide any documentation from State.

    What are the documents I can provide to support that I am not directly working to State and I am only working to the implementation partner directly.


    I would really appreciate your help.

        Hi ther , even I work for implementation to the state just provide the required proof that state will not provide client letter for you . And additionally provide the PO which shows the relation between your implementation and state . Most probably proof of state not providing client letter just provide some email conversations I suggest this because I went by this way . I got 3 years of approval after RFE .

            1 google that location ..
            2 contract with state and implementation partner ..and a letter form u r implementation partner saying that state has no control over u .. and u r employer is the only one who manages u r work ..and if possible a letter or email print out from state that they are not responsible for u r work ..

              one of my friend got the same issue and he requested from the state client that I need an email saying that X Employee working with implementation partner for State of XX in so and so project but as per our state policy we dont give any client letter... USCIS accept this kind of email.... Try to get this kind of letter from ur client..All The Best...

                Check with your Attorney if he had mentioned anything about the client. No one asks unless you mention it. It's the fact about USCIS
