  • Do I have the right to ask my company to provide the H1B application result?

    Hi,

    My company applied H1B for me last year as well as this year. However, I wasn't selected for both years. Now, my OPT is expiring soon in a couple months.

    The situation happens to several other employees in my company as well, we suspect our company didn't file the H1B for us, since the chance that one person didn't get selected is fairly low and all of us didn't get selected is extremely low.

    So I sent an email to our legal department, asking a copy for the H1B petition returned material, and was refused without any reason.

    We are wondering do we have the right to have those materials? If we do, in the current situation, what legal approach shall I seek for such right? (I don't want to hire an attorney right now, I want to find some relative legal regulations and talk to the legal department again first).

        You have the right to receive information. It sounds skeptical on behalf of the company not showing the details. If its a consulting company, please be aware, its a money making industry and people try to falsify things.

          Consult an attorney and seek advise. I beleive you will have the right to ask them regarding the returned H1 packet.

            Your company should give some documents that they have filed for your h1. How did you trust without any kind of document? Now if they said, they never apply or never said that they will apply for your h1B what you can do??? Do you have any documents that mentioned that they have applied or they are supposed to apply for your h1. Think and make a good decision as well as discuss with your friends if they know some suggestion for you.

              You ve the right to know.I think if your consulting firm is old enough if it appears in myvisajobs.com you can get data abt last year.

                  Also myvisajobs will not show the h1packets count which are not selected in lottery ( I assume)

                    But it ll show the total count applied. So atleast one can know if the company actually filed any.

                      Check myvisajobs for 2014 h1b database - there u can find lca information filed by your company.
