  • Can I apply H1 in grace period?

    Hi,

    I didn't receive any update regarding my H1 application..if it was selected in lottery or the packet is on its way back.. I don't know.. Mostly probably it wasn't selected.. My OPT ends on July 5th, I know that we have 60 days grace period to go back home or transfer to school..please help me to understand this

    1) If I find a job in a non-profit organization which is not under cap in those 60 days.. can they apply for my H1 in the grace period?
    2) Or I should find a job which is cap-exempt and apply for H1 before OPT ends?
    3) does everyone have 60days grace period.. Independent of how many days they stayed unemployed during OPT?

    Any insights will be helpful.

        All non-profit organizations are not cap exempt....better to check if the company is cap exempt and then go for H1 with that company!
