OPT end date DEC19,2014. H-1B not selected in lottery. Staying back in Cap-Gap??

  • OPT end date DEC19,2014. H-1B not selected in lottery. Staying back in Cap-Gap??

    I'm a Master's Student and my OPT ends on DEC 19th 2014. I dint get selected in the lottery process.
    I'm aware of joining a school and maintaining the status for staying back in United States.
    are there any other ways to stay back and apply H-1B again. I've heard something about CAP-GAP.
    My Opt is only for 1 year (DEC 19th 2013 - DEC 19th 2014).
    My employment start date is Jan 1st, 2014.
    Could you experts please provide some information

        Her if you are on first OPT can't you Apply for 17 months extension ? .. If you are working for E verified company and you have masters from stem branch and working in your stem job you are eligible to apply for 17 months OPT extension. I would suggest you do that.

          Or else second option is joining is a college course again and getting CPT.

            Try to get a job with CAP exempt employers and apply H1 B through them

              With your question, i assume either you are not eligible for STEM extension or not working for a E-verified employer.

              Cap-Gap is utilized only if your OPT or STEM Ext expires before your change of status to H1B. So Cap-Gap is only applicable between April and September.

              You can maintain your status by joining a University. Most schools have minimum 1 year regulation prior to giving CPT. However, some do give CPT from 1st day itself. So this can be one of your option.

              Also you can try to talk to your employer and reapply for your H1B next year. Since you have a masters degree from an American University you'll again be eligible for the quota.

                  if u r h1 is in processing cap gap automatically added to u r i20 and opt. Check with university to get new i20

                    U guys know any of the university giving CPT from day one, will you be able help on that

                      My OPT is only for 1 year since it doesn't fall under STEM courses.
