  • H1B multiple applications...

    Hi,

    I have couple of questions on the multiple applications filed by the same candidate.

    1) Say for example candidate A has filed 3 different applications through different employers, which is allowed and is not an issue.

    If the candidate is lucky enough and all 3 applications are picked, he will be dropping two applications and will go with one.
    a) WHAT WILL HAPPEN TO THE TWO SLOTS THAT ARE COUNTED TOWARDS THE TOTAL OF 85000. ARE THEY GOING TO BE WASTED FOR THIS YEAR AND IS OF NO USE TO OTHERS.

    2) if 500 candidates does this and leave two each, a total of 1000 are of no use??? HOW ARE THIS 1000 REUSED?

      [B]Attorney Shah Peerally response:[/B] There is a memo alert which mention multiple applications ‎for same candidate same position is not allowed. Based on this we can assume that multiple applications for same candidates through different companies are allowed. In fact, in 2007, few of candidate obtained approvals on multiple applications. Also multiple h1bs are allowed. Therefore, we do not see any problems. Having said that, in case fraud is determined, the applications might be reconsidered. So far, I have not seen anything lately from AILA that actually mentions denials due to multiple applications with different companies. Therefore, I think it will be fine. But this is purely an opinion. Shah

        Thanks for your reply Shah. There is no issue with the multiple applications for the same candidate by different employers. [COLOR="#FFD700"]In fact, in 2007, few of candidate obtained approvals on multiple applications.[/COLOR] Here is the catch, when the candidate is approved on multiple applications, he will be pursuing only one employer. My concern is the other approval(H1B) being wasted and is of no use. Is there any policy which makes this slot to be used again. Thanks!!!!

                  They always take 1- 2% more petition to adjust these redundant forms. And those rarely gets wasted.

                      Eventhough they receive multiple applications for the same candidate from diff employers, it is counted as only one....Thats what is mentioned in uscis website but they didnt mention about how they reuse it

                        if it is counted as one, as in above example where the candidate has filed three applications and was said that only two/one application was picked. what does that mean?
