  • Traveling to home country (in June) after applying H1B

    Hello everyone!

    I'm currently on STEM OPT which is expiring in Dec 2014. I have a valid visa till 2018. My employer is processing my H1B visa this April with premium process. I need to travel to India in this June.

    1. Will I get to know the result of my H1B application by end of April with my premium process application (As I want to travel in June)?
    2. Will there be any problem if I travel to India in June whether or not if I get my H1B visa (as I have valid OPT till Dec 2014 and valid visa)?
    3. If I get my H1B approved before I travel to India in June, do I need to go for H1B stamping if I come back in July (usually H1B starts from October right?).

        If you have approved h1b you can travel ,if it's in pending you can't travel . With approved h1b you have to come back by October 1st , otherwise it will be problem

          2 if you get ur h1 then no prob .. If not you may not get cos ..

              Travel during Cap-Gap Extension Period

              A student granted a cap-gap extension who elects to travel outside the United States during the cap-gap extension period, will not be able to return in F-1 status.The student will need to apply for an H-1B visa at a consular post abroad prior to returning.
