Hello DesiOPT Team,
I need your help in taking some significant decision in a week.
I graduated in May 2013 with MBA degree and my employer filled H1B in 2013 which got denied ( Reason: Education background does not support current job (technical) responsibilities). So, now I enrolled into MSIS program and planning to file H1B again in April 2015 and this time I want to assure my H1B approval. So, I would appreciate if you can provide your expertise to resolve my following doubts.
1. I already used my 12 months of OPT. So, when should I start working on CPT? After one semester or two semesters? I started in spring '14, can I work in this summer for full time? Starting CPT right after first semester would create any problem on H1 in 2015?
2. Is it recommendable to file H1B with the same employer and for the same position again after a year? I did Pega System Architect certification and training.
3. This time I will not be getting OPT and have to get my H1B approval while I am on F1 without OPT status. So, should I finish my degree (MSIS) before filling H1 on April'15 or I can postpone my graduation till the Dec'15?
4. My student visa is expiring on Aug 2015, can I reapply for student visa if want to finish my MSIS degree in Dec'15?
