    Hi,
    I just completed my masters and am joining a company in February which is applying for h1b this April on my behalf.
    I read that it is not advisable to travel before October 1st when the change-of-status is pending.
    Due to some personal reasons, I must travel to India in May-June.
    Is there a way I can work around this?

    Also, say I use the premium petition facility, will I be able to travel once I get a decision (ie. within 15 days) or do I still need to wait till October 1st?

      u can travel after getting the decision thru premium, but then u can only re-enter after u go thru the stamping process n also u ll only be able yo enter like 30-20days before oct 1st

        hmm u dont have to go for stamping to re enter before sep30 ..OP can come on F1 if he is coming back before sep 30
        any way the earliest date you can enter on h1 is 10 before h1 start date ..

          in july u can go for H1 stamping if it is approved well and good ..
          you can come back normally on F1 if you are coming before sep 30 ..
          if u get any 221g also not a problem you still come back on ur f1 ..

            1 apply for h1 in premium u will get result by end of April ..
            2 you can go and come back on F1 if you are coming back before September end ..you dont have to wait til oct1 ..
            there are more advantages if you coming back in july . let me explain in another sub comments ,,

              Dint know tht we dint need stamping if we got back before sept 30. Thanks for lettin me know. Sorry for the wrong info in my earlier post.

                        I have 2 questions

                        1)if h1 was rejected in July can I come back on OPT.

                        2) if so shall I have to apply for my h1 again?

                          One of my friend has to go to India in June. He is in initial opt which ends in October. All are saying that it will be risk while coming back.they are saying that immigration officers may stop him and ask him to come back after stamping.

                            hmm who those all are .. but just ask the CBP .. that is the agency who manages entry and exits ..
