H1b still pending after the RFE is already submitted and past the 60 days .

Please help me. I am H1b applicant for 2013 and my H1 was picked in lottery and latter I was subjected to RFE and my employers says different reasons of RFE requested each time and always ensures that I will recieve my H1 but I am confused and always in fear because my REF was answered on July 10 2013 and the 60 days have already passed and my case is still pending and In between there was GOVERNMENT shut down. My question is how long will the RFE answered stay for.
What status I am in now were in my cap gap I20 is also expired, Can I legally work now still I get the decision from USCIS.My employer is not giving me enough information on this case please help DESI OPT.
