  • How can I stay in US after academic dismissal with F1

    Hi I am F1 student and got academic dismissal after getting a bad grade in a summer course and was denied reinstatement for Fall 2015. I was wondering what my options are now. Can I stay in US as dependent with my wife's F1 or on tourist visa or enroll in some course till I try to reapply for spring? If I go to India, what are my chances of readmission and getting a visa again? I would like to remain anonymous. Thank you for helping, please let me know any suggestions asap.

      How many days ago were you informed about the dismissal?
      Check with your university if they can hold your dismissal for 1-2 weeks time so you can try to get an admit in any other university and transfer your sevis there. If they are not holding it, you will have 60 days to leave the country.

      You should get your sevis transferred to a new university before they cancel it, talk to your international student advisor and check how much time you have and by when you need to get you sevis transferred to your new university.

      Once you know the date when they would cancel your F1 status,
      1) If you have more than 2 weeks keep applying for all universities and mail the specific department admission head, that you want to transfer to their school in fall and if that's possible. This will help you speed up the process.
      2) If it is less than 2 weeks please look for any Language schools(English teaching schools) that allow international students and give F1 Visa. If you find one such school transfer there immediately and keep applying for schools again to start your Master's in Dec - Jan.
      3) You will have to pay for language school, but if you choose not to wait & pay for language school you can go back to India and reapply to come back later.

      I don't know about dependent Visa's or business visa and how they work; So I have not commented about them.

          Hi thank you for your help. I was informed about the dismissal 2 days ago, I have appealed for reinstatement for fall but looks like it is going to be rejected. The international office told me that I have only 2 weeks to leave the country. I am applying for other schools for spring but the process takes time and I am not sure if I can be in the US till the decisions for spring admission and my new i20 comes. I am fine with paying for English school to stay here for a few months, but can you tell me exactly what kind of course it is? Does it have to be a 9 credit course and do I still have to go out of US and come back for my sevis to be transferred to the English school? Please let me know, thanks.

            Also for anyone familiar with the dependent visa process, my fiance is in the US doing her PhD and we thought we can get a marriage certificate as soon as possible and apply for a dependent visa but my university international office told me that I have to have a valid F1 visa to even apply for a F2 dependent visa or I would have to go back to India and apply for dependent visa from there, which is a risk I do not want to take. Is there any other way? Can I use i20 from something like a community college or english school to process the dependent visa? Please let me know, thank you.

              They are just some examples. You can call them and check with them to how long it will take to transfer and check with your international student advisor too.

              Like I said, I have no Idea about f2 or any other visa situations. I'm sorry cant help you with that. hope this helps

                Thanks lalithan, I tried contacting a few schools like that and some other universities as well. The only problem is that my sevis expires next week and I am not sure if the F1 transfer can be done this fast. Do you know if I can continue to stay here after the sevis is terminated if the paperwork for the F1 transfer is being done in the mean time. Please let me know.

                  You can check with them, mostly they would help you transfer.

                  I dont think you can stay if sevis is terminated.

                      I would suggest get an admission into a new university ..cross the border preferably Mexico ..you will get a new sevis number and you should be good ..

                        Even I got "Recommendation to the provost for expulsion of the student" for some academic dishonesty. Could you please suggest me what options I have inorder to continue my education here in the United States, please do help me my whole family is depending on my welfare as I've taken an international student loan because of some cheating what my friend did, he made the university believe that I was the culprit and today I'm facing all these charges. I haven't still been officially notified by the ISO but I received an email saying they are planning to expel me from the university. I'm from India on an F1 visa studying here.

                            Hello guys,

                            I wanted to know what did you do to apply to the NY language center because I also am facing the same situation and my visa might be terminated on January 15th if I do not transfer. Please tell me what needs to be done and the process to keep my F1 status intact.I will really appreciate any help.
