  • OPT expiring Feb 2016 and wedding in November 2015

    Hi guys,

    I am on F1 OPT Stem extension and my OPT expires on Feb 22nd, 2016.
    I am planning to pursue MBA in Spring 2016 ie., January 2016. I am getting married in November 2015 in India. My questions are:

    1.) Since I will registering for courses before my OPT expires and for full time, do I have to go for F1 visa stamping again (*my visa expires in 2016 too)?
    2.) Do i have to take my offer letter from my employer for visa stamping?
    3.) I will be taking my spouse with me to USA? How hard or easy is to get F2 visa for my husband? If an employer sponsors him a H1B, can he apply for H1B in 2016?
    4. ) What documents would be necessary for me to file for a visa application for my visa and my husband's visa?

    Your answers would mean a lot. Thank you in advance for all the suggestions.

        1. If you have a valid f1 stamp you need not go for stamping I guess. But wait for more answers on that question.
        2. If u have to go to stamping regardless, you will need offer letter, pay stubs and many other relevent documents.
        3.F2 visa should'nt be very hard if you have all documents in place. You will need a dependent I20 from yout university. H1b is getting tricky, it's a lottery system with in the number of applicants. Think of some other alternatives as well other than h1b.
        4. Offer letters,pay stubs, I20, tax documents, ead card, marriage certificate, bank statements showing enough funds to support your education and your spouse. They expect a balance of $50k if u r planning to study and bringing your spouse.

          If you return to US before your current visa expires, then you can use the same visa and enter US. If not, you would need f1 stamping again. I would suggest you to return before current f1 visa expires as f1 renewal is risky. Getting f2 is not too difficult. when your husband comes to the US, he can convert his visa from f2 to f1, start working and his employer can file h1b for him in 2016.
