I am currently on F-1 visa and my h-1b was not selected in the lottery. My OPT is expiring soon. I am planning to go back to school and get part time CPT so that i can continue working part time with the same company. Meanwhile, my company wants to start with atleast PERM processing (labor certification), while I am on F-1 visa.
1. Is there an issue while starting PERM processing while I am on F-1 visa? I am still going to try next year again for H-1. Will approved PERM/ i 140 hinder change of status to h1?
2. If the EADs are given for approved I 140’s (may or may not - executive action), can I work with the EAD after if my I 140 gets approved while I am still attending classes and maintain f1 status?(in case h-1b application does not go through lottery next year too)
In any case, I am trying to atleast start this process early since the backlogs are huge. Since H-1B visas are getting tougher every year, I do not know what else the options are.
