Urgent! Filing for I 140 from F1 visa

Hi all,
My STEM OPT is expiring soon and h-1 is not selected in the lottery. Planning to join some college to maintain status. I see a proposed rule that may give work authorization for approved I 140s. So what is the impact of that if it goes into effect? Can my employer file I-140 while I am on F1 visa without having to obtain h-1? Are there any risks? How long does it take to get approved? I see in some forums that people have gotten their I 140 approved while on F1 visa.
