  • How to regain my status

    I am MS student (F1) of an US university. Last fall, I was suspended for one semester for disciplinary issue. Now, I am in India. My suspension will be finished on 18th May. Then I want to return university. I left only thesis. After finishing my suspension, I have to request for new I20. As I am in India, I have to pay for new sevis (as reinstatement is not possible). Now, my question is that:
    1. Should I go for visa interview again? (my visa is valid till more 3 years)
    2. With new I20 and sevis, when I ll reach port of entry, should officers make any trouble? If so, how can I overcome them?
    3. In the total process, is there any risk factor? If yes, how can I overcome?
    4. Reaching there, can I apply for PhD?
    5. Any problem may occur in future?
    6. Any other suggestion?

        1. Generally, you need to apply for a new visa, especially if it has been more than 5 months since you last left the U.S. You should discuss this with your advisor.
        2. The officer may not realize that there was any issue. If they do ask questions, you will need to explain that you were suspended and that you are now returning. Generally, if you were able to obtain a new visa, they should not prevent you from entering. Be honest.
        3. There is no guarantee that you will obtain the visa. Since you only have the thesis remaining, the Consulate can say that there is no need for you to come to the U.S. and that you can write the thesis from home. If you need to present in the U.S., you may want to get a letter from your department, explaining how difficult it will be do a thesis if you are not on campus.
        4. Yes, you can.
        5. The suspension will always be on the record. So, for example, when you apply for the PhD, the school will want to know reason for suspension (whether it was academic, disciplinary/criminal, or something else).
