  • about gaining back F1 Visa Status from Out of status and returning back to USA

    Hi , all ,

    i am in serious trouble i need help !!

    i am student studying for associate degree , i finished my all required credits by may 2014 ( around 60 credits ), after that i decided to take a semester off because of money crisis and financial reasons and economic hardship , and then i returned in November 2014 at my school for graduation , but when i returned my course adviser said , i am no longer in status , moreover they said i still miss one course as per new graduation requirements in 2014 (compared to old one in 2012 ) , i asked them reason behind terminating my i20 and SEVIS records , and they said because i did not report them back while i took semester off that is why they ended up terminating SEVIS record , now they are ready to issue me new i20 , and they are asking me to go out of country and come back with new I20 and new I94 arrival departure number i am perfectly fine with doing it , however i have some questions ,

    > because my SEVIS and I20 was terminated , when i go out of USA and when i come back will immigration officer ask question why my SEVIS was terminated ? if answer is yes then what is the best answer that i can give , can i say that because i had economic hardship that is why i was unable to join semester and continue my studies ? or they will refuse my entry in USA

    i am very good and regular student , but i am terribly worried if officr will let me come in USA and if they will let me finish my degree

        You should speak with an attorney to see if you need to get a new visa or if you can still use the visa in your passport. As you violated your status when you didn’t go to school, you may be required to get a new visa. This is a bigger issue than dealing with it at the border. Your attorney can tell you if going out and coming back is better option than having your F-1 reinstated.

              If it's the same university that mentioned on your visa then less questions probably !! Take all the proper documentation and explain him clearly your situation!!

                Take a letter from your dso explaining the whole situation..show it to them when asked..you can first explain verbally n then show the letter as well if required.. That would be good enough I guess..would clear all confusion...

                    1) yes
                    2) dont worry they wont ask y ur sevis was terminated, but they ll ask y you need a new sevis. You can say my DSO wanted me to get an updated I-94. All the officer at the immigration cares abt is if u have a criminal background. Plus they would have all ur info when they run ur passport no itself. Questions r just a formality. I ve been thru this last October. So dont panic and good luck!!
