  • arrested for rising bicycle on highway

    Hi ,
    I have been arrested by sherrif for riding a bicycle on inter state highway(interstate I-135) and he asked my took me to the jail . and after 15 minutes i was released and they took my fingerprints and did all other usual formalities and gave me a court date .
    I waited till my court and then went to the court and they asked me to pay a fine for riding the bicycle on highway .But i refused to pay fine and requested them that i did not even apply for the drivers license and i am new to this country and i never know that riding bicycle on highway is crime and asked them for dismissal of the case but they refused and gave me a another court date .
    I request you to please help me with this and suggest me what to do should i pay fine or not . what other things i can do

    1. Is this gonna create a problem for my opt . or opt extension .
    2. Is this gonna create a problem for my H1-B VISA .
    3. Should i tell that i was arrested and found as a misnomear while applying for drivers license

    Please help me

      Saikiran:- Sorry about your experience and i understand its unfortunate.

      I think the better way to get away is to pay the fine and you dont need a driver license to ride a bicycle. The responses to your questions are


      1. No
      2. No
      3. Not unless specified but refrain from applying to a drivers license until the case has been expunged.

      I would say its better to go by paying the fine or talk to the attorney during your court date or hire a attorney seeking legal advise.

        if i have paid the fine and then go to apply for the divers license then they generally ask certain question like , now as the case is closed as i have paid the fine but still this is true that i was arrest and was taken to jail so what should i answer to the following questions .

        1.have u ever being arrest if yes then why ?
        2. have u ever being convicted of any crime ?
        3. have u been ever being to the jail?

          3. Yes- reason

          I dont remember filling a form going to the DMV office. Just provide the docs and proof of your status it should go through without hassles. You paid the fine, case is dismissed and expunged.

                When you come to a new country you are supposed to know its law, not knowing about a law is never an excuse for a crime. As of now, just pay the fine and 6 months later try to expunge it from your record

                      When you fill your ds160 it will always ask for arrest or conviction records, when you go for stamping they will ask questions based on ds160. It is in your best interest to visit an attorney and see how the record can be taken away or handled. in any documentation employment related or not they will always ask you if you have been previously convicted or arrested.

                        One they have ur finger prints it's in their system, so you have to answer yes to that question on DS160 every time you fill out. My friend was arrested for DUI, but he got the case dismissed with help of lawyer and next he went back home for visa re stamping back home he answered no to that question, they rejected him as they found all his records in the system and said he was lying and told him to re-apply.

                          its not going to effect any thing just pay the fine and when ever their is a back ground verification please do mention it .as my friend lost his full time job for not mentioning in the background verification.we all are humans and make mistakes .so nothing to worry .

                              There are always signs posted at the entrance ramp to any freeway - no pedestrians no bicycles motor vehicles above 125 CC only. The rules are well defined and displayed. It is we who has to understand.
