  • Urgent B1 to F1 stamping question

This is an inquiry on behalf of my friend:

"I came to US from India on B1 visa in the month of August 2012. I applied for F1 Visa 4 months after I came to US which got approved after 3 months since then, i.e, March 2013. My petition is valid from March 2013 through July 2015. This is my final semester as a student. I am planning to go to Canada or Jamaica to get my visa stamped.

Please input your comments on chances of getting my visa stamped? Is it suggestible to go for the stamping? If yes, which location is preferable?

You should reconsider going to either Canada or Jamaica as neither is likely to entertain your application. For Canada, they will generally not entertain an F-1 visa or any other visa category applicant from a third country if they have entered the US in B-1 or B-2 status and then changed their status in the U.S. (the only exception I’ve seen is that they will entertain an H-1B visa application if you have a US degree). If this is your first F-1 visa stamping, Canada will most likely tell you to apply back in India.
While Jamaica does not have such policy posted, it is best to contact them before your trip to see if they will entertain a third country national who is getting their first non-visitor visa stamping.
Before you go, contact the US Consulate and find out if they will actually process your application before you spend the money and make the trip.
In India, you should be able to get your visa stamped if you’re close to the end as the consulate may want to make sure you can complete your degree, but you must present very strong proof of your ties to your home country and that you will return after completion of your studies.
