  • Advice beyond US F1 Student Visa

    Hi all,

Thank you for any help and apologies if similar questions have been posted before. I am posting on behalf of my girlfriend - she is a Canadian citizen who spent 5 years in the US on an F1 visa. After losing the H1-B lottery, she moved back to Toronto and started working there.

I am still in the US, and so she frequently comes to visit. She has lately raised concerns about the "90 day travel limit" beyond the termination of her F1 and has asked me to do any research I can to get clear answers. Essentially, our questions are:

    - After losing the lottery, she stayed in the US for another month or so (what I understand to be a "grace period"). Do these days count against the 90 day limit?

    - Does classifying travel back into the US as "business" rather than "personal" change the impact on the 90 day limit? Are there any other repercussions? (She does frequently travel here for work as well)

I am still learning a lot about the immigration process and appreciate any help with the questions above, as well as any advice on managing an international relationship (with regards to legal limitations of travel) moving forward. Thanks again!
