    I am working on CPT as an intern on stipend in Chicago with a trading company which has been registered with the university and I will be graduating in May 2015. My boss told me that he is the managing partner but I looked up the company name on cyberdriveillinois.com which is secretary of state website and saw that only his partner's name is registered as a manager and not his. So I think my boss is an independent contractor and he hired me as an intern and signed all the offer letters for my employment. Can he do that is it legal? I received $750 in February 2015 on behalf of another company. I asked my boss and he said that as it is a trading company the other company manages their account. I think that my internship is illegal as the paychecks I received are on the name of a different company and my boss is an independent contractor who hired me as an intern on behalf of the company. Also my employer has not taken any of my details like SSN, I 20 and told me he wont be giving me W2 form next year as I am an intern and not an employee. I have applied for OPT and my OPT packets with the CPT I-20's will reach the USCIS tomorrow I can call FEDEX and cancel it. In the future when I apply for OPT the USCIS govt can put an RFE on my CPT. I want to know if I tell my career center that my internship is illegal citing above reasons and considering that my OPT packet is reaching USCIS what are the consequences?

        technicaly speaking you are not suppose to do that .since he has not taken your ssn and other details he is not going to run your pay roll .but I think you are ok for now but in the future if you get an RFE which I dont think so you should be able to get a letter from the company stating you worked as a volunteer .there is no offical pay roll ran on your name . I assume its just a company check that they have given you .

          I had submitted this question. My boss said that he is a managing partner but when I checked the companies profile on cyberdriveillinois website I couldn't find his name but I did find his partners name which he often mentions. The company is officially registered with the state at his partners residence address and his partner trades from home and doesn't work with us. My boss has signed all the offer letters and all the addresses on it are at the addresses registered with the exchange where we phyically work and not with the state. I think my boss is an independent contractor when I asked him about it he states that he is an independent trader as well as managing partner of the LLC. He said he has signed a contract with his partner and he manages all the business for the company. My question is can he as an Independent contractor hire me as an intern on stipend, is it legal for him to do so?
