  • Working more than 24 hours in parttime CPT

    Hi,
    I am new to this forum. I have some important issue that needs to be answered and i thought this is the place i need to ask.I am doing my masters from georgia tech university in computer science.I am in my last semester and I got an internship. I am doing my graduate assistantship for 16 hours so i thought of doing remaining 24 hrs internship which makes total of 40 hours. I applied for cpt and started working. Today i realized that university people gave me part time cpt and When i did some research I found that if we are in cpt we need to work only 20 hours.I am working an extra 4 hours. I am really in a state of confusion .Is it illegal? if so, what are my options.Can I tell the employer about the situation,the thing is they really dont know much about immigration system.


    Can some one please answer my question.

    I am not working more than 24 hours but i am working 24 hours instead of 20

        1. As per law, you can work upto 40 hours under CPT in your field. Since your college approved a part-time CPT, it means that your internship required you to work under 20 hours a week.
        2. Your negligence about the law will not be considered as a mistake, but a will full ignorance. Therefore, stop your work right away and work only upto 20 hours a week. Double check on your CPT I20; and do not continue to work above 20 hours.

        I can understand your situation as I have been through a similar situation and it does not work out well. Since now you are aware of the situation; inform your employer honestly and stop working over 20 hours on CPT. I donot wish to scare you; but such situations turn out really bad and university/International student services office donot consider or show any mercy if you are at fault.

        I hope this helps; correct me if I am wrong and best of luck for the future.
        Wait for the admin's answer on this page; In the mean time do call USCIS office and confirm the CPT rule.

            talk to your DSO, as my understanding, it's 20 hrs in total when you are still in school. If you do 16 hr GA in school, means you can only take 4 hrs off campus internship. In this case, you are working full time, in my DSO's word, "trying to trick the system", which is way above 20 hrs and yes it's illegal

              While you sre enrolled in classes, you can only work 20hrs/week on parttime cpt. However with fulltime CPT, can work upto 40hrs/week during vacation. However you already are working more than 20 hrs. It is illegal. I would advice to contact your DSO. They might cancel your sevis and issue you new i20. Based on that tou have to leave the country and reenter to activate new sevis. One of my friend had similar incident where he ended up being not eligible for OPT. BOTTOM LINE - CONTACT YOUR DSO ASAP.
