    H1 transfer

    Hello, I was working for a company since last October. They filed my h1b and got approved as well. I was laid off in august last week. I started applying for jobs and got a new one. New company has already started h1b transfer process. But currently I am on a cap gap. What if transfer process takes more time than expected and I can't get decision before 30th sep. Do I need to apply for further education? Or I can stay after 30th sep. my previous employer won't be sending termination later until October 1st.

    I am too in similar situation and I got receipt 2 months ago, but still there is no update as of yet.

    You should speak with the attorney. Your status will change to H-1B on October 1. If you’re going to go back to school, you need to speak with your DSO immediately as your SEVIS is set to terminate on September 30.
    Theoretically, under H-1B portability provisions, you should be able to begin working for the new employer as long as the H-1B change of employer petition was filed. Again, speak with the attorney.
