You have to be on that minimum salary from the start date of your H1-B. An accountant in New York, New York is going to require a greater starting salary than a market research analyst for example. An accountant who is renewing her H-1B may require a greater salary than someone who is obtaining their first H-1B because they have more experience.

For nonimmigrants the min salary is not a fixed rate and it does not DOE. Your min salary is determined by the company. Remember what they are doing for you, they are changing your life. Your min salary depends on your personality and respect. If you be to serious they aint going to like you and if you be too elastic, they aren't going to respect you. So let your min salary be what you currently researched and give the employer your references AND also tell them that you understand that I am a nonimmigrant and willing to take a pay cut in order to work for your company in the long run (i.e. sponsorship.) The problem is that the majority of EADS are from Indians and that is why they are being targeted by USCIS. What about the other international countries. And don't be fooled, the government will state that is is doing this to reduce h1bs to "foreign countries". What he really means is that he is doing it to those Indian consulting companies who don't HIRE AMERICANS. That is the reason why so much sanctions are occurring. Those DESI COMPANIES only hiring INDIANS like this is INDIA and like AMERICA has a CASTE system. Geeeezzz Just hire AMERICANS or USCIS will shut you down.
