Received rejection notice for STEM-OPT application

Hi,

I got a new job and applied for a STEM extension on 3rd Feb. My EAD (For OPT) expired on 9th Feb. On 25th Feb I received a rejection notice from the USCIS lockbox because the I-765 form was outdated. I spoke with my DSO and he told me that my STEM application will not be valid as I would be resubmitting it after the EAD has expired. I informed the same to my employer and they said they would not be continuing with me and I got laid off.

Recently, I learned that USCIS is ready to accept my STEM application if it got rejected by the lockbox for the above reason. Now that I’ve been laid off, I want to know if I can proceed to stay and work in the US(When I get a different job) or If I have to return back home.

Please advise on the best course of action. Thanks.
