    Exclamation H1B Transfer

    Hello,

    My I-94 has expired and H1B extension was filed in normal processing. I received the Receipt copy (I-797C) from USCIS. But due to Covid-19 situation I am getting laid off. Because of this, my current company will not change my H1B extension to premium processing.

    The question is, if I land another job can I apply for a H1B transfer with my current Receipt copy?

    Please share your thoughts on this. Thank you.

    The situation is unpredictable.

    1. If your H1 transfer is approved without RFE mostly like you are safe. Once you get a new job apply for Amendment employer change.
    2. If RFE and if you get a job by end. Apply for amendment with RFE along with client letter.
    3. If RFE but no job, talk to an attorney or employer.
    4. If H1 denied - you are out of visa and you will have to leave the country asap as your I94 has expired stay away from USCIS. USCIS, Homeland and ICE they are shameless they don't care about covid situation all this is trumps business so plan and be more alert about your immigration. Most immigration attorney's are frauds - your employer will also think about his safety and may not give you all information.

    Please plan for the worst in case of emergency and you will never feel sorry about the situation. There is no LAW for immigration its all luck. I've worked with various lawyers and employers
