    H1-B Transfer while H1-B amendment in progress


    My H1-B amendment (for change of location where an additional working location has been added to the list of previous working locations and its for the same product) with my current Employer A is in progress. I received an RFE whose response has been filed (but its still in progress).
    I have received an offer letter from employer B.

    1) Is it okay/possible to start my H1-B transfer to employer B while my H1-B amendment with employer A is in progress?
    2) If Yes, do you see any potential issues in the transfer?

    Yes you can change your employer and the new employer will file H1B COE(Change of Employer). Every petition will be considered as a new one so there shouldn’t be any issues. You can even discuss this with your attoney who is reponsible for filing your new petition.

    1. Yes, it’s permissible.
    2. With the suspension of Premium Processing, it’s risky to join the new employer until their H-1B petition is approved.
