    OPT STEM Extension under staffing agency -Reg.

    Hello,
    I am currently employed by a staffing company "A" working in one of its client company "B". Which is under my area of specialization. My employer runs the paycheck and is an E-verified company. My employer office is also at the client site so that I have quarterly reporting and performance review. I am going to apply for my STEM- OPT extension and got my I-20 from my university [ I-983 signed by employer].

    I was looking through the internet and I am seeing that OPT-STEM extension wont be approved if you are employed under a staffing company. Is it true?.
    My employer is aware of the training I will be getting when working for the client company. I am not sure what to do now, will my OPT STEM extension be approved?.

    Hey Killar,

    i am in the same position and applied to STEM OPT recently and got rejection due to old version of I 765 form, They requested to resend all the documents with proper versions. And even I am working for Staffing Company and they signed my I 983. Please do let me know If you get any info

    Will do, I just want to know if any other has gotten their extension approved. All I see is that Staffing company does not provide a bonafide employer-employee relationship. Will be helpful if other members can pitch in on this

    Update: I have sent my application packet to USCIS today, will keep updating of the process.

    On internet generally all guys who didn't end up well post the reviews, you may be asked for additional evidence also called rfe, there's entire session of employment through staffing agencs on their site https://www.uscis.gov/.../staffing-agencies-may-complete...

    Hi,

    I am in a similar situation, but my employer(staffing agency) is in a dilemma whether to sign the I-983 unlike yours is not that case. Do you know anyone or talked to someone whose OPT extension got approved under staffing agency?

    Hello,
    I hope you are aware of the new changes by USCIS regarding employment through third party/staffing.
    Explain your situation to your staffing agency, and for Extension they should be E-verified Employer.[Other option is to look for new employment or get help from a consultant] .
    In my case I explained them and they were willing to sign the I-983, but now the new updated rule by USCIS , I am not sure how it will turn out.

    Hi,

    I am aware of all the changes but still my employer is not willing to sign. I am looking for new position/employer and continue working until i find one. Good luck!
