View Full Version : F1 OPT to H4 Change of Status

Hi,

I recently got married and will soon apply for COS from F1 OPT to H4 and H4 EAD (probably in coming couple of weeks), do I still need to comply with F1 OPT requirement of getting a job and be employed within 3 months of start of my OPT? My OPT started on April 17, 2017, which makes 3 months to July 16, 2017 and my COS might not be done by that time. Will USCIS consider my COS request and exempt me from 3 months employment clause?

Nope, uscis won't consider any COS in process as it is never guranteed of approval until it's approved. U have to follow f1/opt guidelines until ur h4 is approved. You won't be able to work once ur h4 is approved and u may need to wait for h4ead. In most cases h4 and h4ead do not comes at same time. Timelines are different for both.

Recently I changed my status from F1 to H4. I applied both H4 and H4 EAD at the same time and got them approved in two months at same time. And in your application you can give change of status effective date(a future date) from when you want to be on H4.
